9. Intellectual Property
9.1 The Host Institution and Principal Investigator have a duty to the public to ensure that discoveries and advancements in knowledge arising from the Grant Funded Activities are translated for public benefit including but not limited to commercial development of new therapies, diagnostics and software for health.
9.2 The Host Institution must subscribe to the Intellectual Property Guidelines agreed by the HRB and other Irish funding agencies to ensure transparent and consistent procedures for managing Intellectual Property from publicly funded research.
9.3 The Host Institution shall:-
9.3.1 Devise, publish, implement and maintain procedures for the management of Intellectual Property arising from the Grant Funded Activities and in particular but without prejudice to the generality of the foregoing shall use all reasonable endeavours to ensure that:-
9.3.1.1 The Intellectual Property of the Grant Funded Activities is identified, recorded and carefully distinguished from the other outputs of other research.
9.3.1.2 The Intellectual Property of the Grant Funded Activities is appropriately protected prior to any publication.
9.3.2 Ensure that the Principal Investigator assists with the development of the appropriate commercial strategies referred to above.
9.3.3 Inform the HRB of any outputs which are capable of exploitation whether patentable or not.
9.3.4 Permit the HRB to audit the Host Institution’s policies and procedures for the management of Intellectual Property.
9.4 The HRB makes no claim to any Intellectual Property arising from the Grant Funded Activities.
